Title IX & the Clery Act: Conduct Live Hearings that Are Trauma-Informed and Ensure Due Process – September 19, 2018 Webinar CD

The University of Michigan was recently instructed by a federal judge to hold a live hearing during a sexual assault investigation so the accused student could question his accuser. The male student had sued the University in June, alleging that the institution's sexual assault policies didn't provide him with due process rights. Will the judge’s decisions have national implications regarding the rights of accused students to question evidence against them?

• A working understanding of the emerging legal issues and trends in sexual misconduct processes and hearings, including concerns related to due process and trauma informed processes – ensure your hearings are fair and compliant. 

•  A brief discussion of investigations – lay the foundation for successful hearings so you don’t sink the entire process.
  
• Explore a variety of cross-examination methods – including live cross examination through the hearing officer, remote cross examination, pre-submitted questioning, and questioning through technological devices submitted to the hearing officer – figure out what’s right for you so you can avoid mis-steps and violations in due process.
• Types of sexual misconduct processes, including the civil rights investigation model and the hearing model – determine which type of hearing is appropriate to use when. 
  
• The ability to conduct a process that complies with each of the federal laws (including the Clery Act and Title IX) as they relate to sexual misconduct processes, and in particular, hearings – Set up your hearing room, script the hearing for the hearing officer, establish flexible scheduling for witness participation, consider accommodations for the hearing and incorporate methods of cross examination successfully.
