Institutions offering educational programs, or engaging in other related activities, may be required to meet regulatory requirements and obtain authorization from their state licensing agency. Although the advent of the State Authorization Reciprocity Agreement (SARA) has made compliance with these requirements easier in many aspects, SARA carries its own compliance challenges, and key gaps in the reciprocity agreement remain. In addition, the U.S. Department of Education recently issued new rules that if unchanged would substantially raise the cost and risk of compliance for institutions that fail to satisfy state authorization requirements.
